Terms and Conditions 1. Definitions “Customer” / “you” – the individual or entity purchasing or using our Services. “Services” – any hosting, VPS, dedicated server, game server, or related service provided by RiseServers.net. “Agreement” – these Terms and Conditions, including our Acceptable Use Policy and any other policies referenced herein. 2. Services Provided 2.1 We provide hosting services on a best-effort basis with a 99.8% uptime target. 2.2 Services are provisioned following successful payment. 2.3 Service details, features, and specifications are outlined on our website and may be updated without notice. 3. Account & Customer Obligations 3.1 You agree to provide accurate contact and billing information. 3.2 You are solely responsible for securing your account, passwords, and data. 3.3 You are responsible for all activity originating from your account, whether authorized or unauthorized. 4. Acceptable Use Policy 4.1 Prohibited activities include, but are not limited to: Cryptocurrency mining of any kind. Hosting, promoting, or distributing adult content. Hosting, distributing, or promoting child sexual abuse material (CSAM) — zero tolerance. Use of SMTP ports 25 and 587 for outbound mail. Spam, malware, phishing, botnets, denial of service attacks, or port scanning. Activities that disrupt network performance or other customers’ services. 4.2 Violations may result in immediate suspension or termination without refund. 5. Payments, Billing & Refunds 5.1 All payments must be made in advance of service delivery. 5.2 All sales are final. Refunds will only be issued if we fail to deliver the purchased service. 5.3 Chargebacks or payment disputes will result in immediate suspension and may incur additional fees. 5.4 Services may renew automatically unless canceled prior to the next billing cycle. 5.5 Failure to pay invoices may result in suspension or termination of Services. 6. Service Availability & SLA 6.1 We target 99.8% uptime excluding: Scheduled maintenance. Force majeure events (e.g., natural disasters, major network outages, DDoS attacks). Customer misconfiguration or misuse. 6.2 We may, at our discretion, provide account credits for downtime exceeding this target, but such credits are the sole remedy for service interruptions. 7. Data & Backups 7.1 Customers are responsible for maintaining their own data backups. 7.2 We do not guarantee data recovery in the event of hardware failure, corruption, or account termination. 8. Support 8.1 Support is provided via methods listed on our website (e.g., ticket system, email). 8.2 Support covers only the functionality of our infrastructure; we do not provide support for customer applications, software, or third-party configurations. 9. Suspension & Termination 9.1 We may suspend or terminate Services if you: Fail to pay invoices. Breach this Agreement. Engage in abusive, illegal, or harmful activity. 9.2 In the event of termination for cause, no refunds will be issued. 10. Intellectual Property 10.1 All software, designs, and systems provided by RiseServers.net remain our property. 10.2 Customers retain ownership of their content, provided it complies with these Terms. 11. Indemnification You agree to indemnify, defend, and hold harmless RiseServers.net, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services. 12. Limitation of Liability 12.1 Services are provided “as is” without warranties of any kind. 12.2 Our total liability shall not exceed the amount paid by you for Services in the last 30 days. 12.3 We are not responsible for loss of business, data, or profits resulting from use or inability to use our Services. 13. Governing Law This Agreement shall be governed by the laws of the United States and the state in which RiseServers.net operates. 14. Miscellaneous Severability: If any provision is held invalid, the remaining Terms remain enforceable. Waiver: Failure to enforce any provision does not constitute a waiver of our rights. Modifications: We may update these Terms at any time. Continued use of Services after changes take effect constitutes acceptance.
